Features of Forms of Protection of Rights in Ukraine: Tasks of the Security Service of Ukraine and Civil Proceedings

The article deals with legally established forms of protection of civil rights in Ukraine, their features and specifics through the prism of the challenges of the present. The concept of “protection” covers a wide range of tools that ensure the existence of civil legal relations, and is one of the components of the formation and operation of the latter. That is why the interpretation of the specified concept allows to deeper know the nature of the forms of protection of civil rights and freedoms of participants in civil-legal and civil-procedural relations. Conditionally, the form is a material embodiment of protection by which the right to protect the participants in civil legal relations is ensured. Article 55 of the Constitution of Ukraine consolidated the postulate that proclaims that each person has the right to protect his rights and freedoms from illegal encroachments and violations. However, such remedies cannot go into a cutoff with the current legislation and go to its permissible limits. The author conducted a general analysis of jurisdictional and non-legal forms of protection of civil rights of participants in legal relations. In this paper, emphasis on jurisdiction forms of protection of civil rights (judicial, administrative and notarial) is made. The issues of place of arbitration courts and international arbitration in the system of judicial form of protection of rights in civil legal relations were also highlighted. In addition, the issue of the Security Service of Ukraine in the System of Protection of Rights and Freedoms in the Context of Civil Relations was considered. Despite the fact that the Security Service of Ukraine in its activities more attracts to the sphere of criminal law and criminal procedural relations, but as a participant in civil and civil procedural relations, this body can and uses declared forms of protection of civil rights in case of their violation.
