INSURANCE SYSTEM AS A MECHANISM TO COMPENSATE FOR ENVIRONMENTAL DAMAGE

Environmental pollution is considered serious damage due to its wide scope in time and place, which led to the inability of the civil liability rules in their classic sense to absorb all its effects, which often go beyond the state’s territorial boundaries, thus violating the principle of state’s sovereignty over its territory, which makes it difficult to find an alternative legal system for the substantive and procedural rules. For civil liability, therefore, many international legislations and agreements have adopted what is known as the environmental damage insurance system, the latter in which the jurisprudential opinions differed between supporters of insurance as an alternative system to civil liability rules, and opponents in view of the technical conditions on which the insurance system is based
