Juridical Tools of Russian Aggression against Ukraine

The article is devoted to aspects of usage by Russian Federation the normative (juridical) tools for realisation the key tasks of this state in its aggression against Ukraine. The goal of the article was determined in forming the common approach for the major juridical tools, used by Russia in framework of its aggression. And as the authors revised a broad set of the normative acts and drafts, also as the judicial and administrative decisions, they took into account the criteria of the media reflection the relevant processes. There was proved that the strategy and tactic of Ukrainian legal tools for the counteraction the aggression have no adequate scientific background. Authors made the analysis of the relevant actions in the universal and regional international jurisdictions, also as in the legal systems of Ukraine, Russia and third countries. There is proved that the absence of the coordinated legal policy for counteraction the Russian aggression in such conditions will result inevitably into the irreparable and large-scale negative legal consequences. Authors prove that the key efforts of Russian legal policy in Ukrainian national jurisdiction are in areas of passing suits to administrative courts, degrading the order of the criminal proceedings and lobbying the preservation of some suitable legal mechanisms in Ukraine. Relevant efforts in Russian national jurisdiction are preparing and usage the normative grounds for covering Ukrainian residents by Russian citizenship, for universal jurisdiction in cases against Ukrainian combatants, for expansion the Russia-controlled zone in Black and Azov Seas etc. Article reflects the efforts of Russia in third countries’ jurisdiction for de-facto or indirect agree with the attempt of annexation the Crimea by Russia, for the qualification the conflict on the East of Ukraine as the “internal” one, for establishment the “civil international tribunals” against Ukraine. The discussions on creating or establishing the state body, responsible for the relevant coordination, were mentioned, the experience of the high-level commissions, established formally in Ukraine since the beginning of the interstate conflict was criticised as non-effective. The Russian experience of special working groups of lawyers, collected from the relevant state military, intelligence, administrative and civil agencies, and acting in juristic framework against Ukraine, was pointed as more successful in conditions of the ongoing interstate conflict
