The System of Normative Legal Acts that Regulate the Administrative Legal Relations of the Implementation of the Right to Use Natural Objects of the Right of Ownership of the People of Ukraine

The article introduces the system of normative legal acts regulating the administrative legal relations of the implementation of the right to use natural objects of the property rights of the people of Ukraine. Within the framework of the article, a classification of the named normative legal acts was carried out, according to the results of which they were differentiated into the following groups: 1) general: laying the foundations for the regulation of administrative legal relations of the realization of the right to use natural objects of the property rights of the people of Ukraine; regulating the legal status of subjects of public administration; establishing the foundations and regulating the procedure for the activities of subjects of public administration for certain functions of public administration; regulating public participation in public administration in this area; 2) special: basic, which include a number of codes and laws on natural resources, and concretizing, constituting laws and predominantly subordinate normative legal acts, most of which are devoted to the procedures for the activities of subjects of public administration in the areas of performance of specific functions of public administration. The features and significance of the division of normative legal acts into separate varieties were commented. The article paid special attention to the current state of the normative legal regulation of these relations, which are characteristic of an extensive system of normative legal acts, which is formed by a large number of normative documents of different legal force. It was noted about its inherent problems, among which the failure to comply with the requirements of the main special regulatory legal acts, gaps in legislation and other shortcomings was revealed. The ways of their solution are proposed. In particular, recommendations were formulated to improve the Water Code of Ukraine, the laws of Ukraine “On the Flora”, “On the Natural Reserve Fund”, as well as on the need to adopt normative legal acts of a subordinate level, which will approve the relevant procedures for the activities of public administration entities in areas of implementation the following functions of public administration. They are aimed, in particular, at ensuring the realization of the right to use natural objects of the property rights of the people of Ukraine: control, permitting (for natural objects of the flora), monitoring (for forest, animal and plant resources), regulation (for water use), certification (forest resources)
