Jaminan Keadilan bagi Masyarakat Adat Nusantara

Law number 5 of 1960 concerning Agrarian Principles and Regulation of the Minister of Agrarian Af airs/Head of BPN number 5 of 1999 regarding the implementation of ulayat land. In this article, it directly gives hope for justice for the management and ownership of land of Indonesian customary law communities. In fact, this customary right still raises a consideration and has not been clearly regulated. Due to the many conflicts related to customary law, guarantees of justice are indeed needed. Because with this guarantee of justice, it can protect the indigenous people of the archipelago. Legal protection must consider the stages, namely legal protection from laws and regulations and all laws and regulations provided by this municipality are basically community agreements that regulate behavioral relations between community members and government individuals who represent the interests of the community. Indigenous and tribal peoples throughout Indonesia carry out various law enforcement ef orts to regain their rights, either by force or by other means, by the government or by a certain group of people. Undang-undang Nomor 5 Tahun 1960 tentang Pokok-pokok Agraria dan Peraturan Menteri Agraria/Kepala BPN Nomor 5 Tahun 1999 tentang Penyelenggaraan Tanah Ulayat. Pasal ini secara langsung memberikan harapan akan keadilan bagi pengelolaan dan pemilikan tanah masyarakat hukum adat Indonesia. Kenyataannya, hak ulayat ini masih menjadi pertimbangan dan belum diatur secara jelas. Karena banyaknya konflik yang berkaitan dengan hukum adat, jaminan keadilan memang diperlukan. Karena dengan jaminan keadilan ini dapat melindungi masyarakat adat nusantara. Perlindungan hukum harus memperhatikan tahapan-tahapan yaitu perlindungan hukum dari peraturan perundang-undangan dan semua peraturan perundang-undangan yang diberikan oleh kotamadya ini pada dasarnya merupakan kesepakatan masyarakat yang mengatur hubungan perilaku antara anggota masyarakat dengan individu pemerintah yang mewakili kepentingan masyarakat. Masyarakat hukum adat di seluruh Indonesia melakukan berbagai upaya penegakan hukum untuk mendapatkan kembali hak-haknya, baik secara paksa maupun dengan cara lain, oleh pemerintah atau oleh sekelompok orang tertentu
