Latest Changes in the Current Land Legislation: Current Issues

The article considers the changes that will be made with the adoption of the Law "On Amendments to Certain Legislative Acts of Ukraine on the Circulation of Agricultural Land" due to the opening of the land market. The issue of a moratorium on the sale and alienation of agricultural land has been studied. For some reason, this provision includes the lack of infrastructure in Ukraine to introduce a market for the purchase and sale of agricultural land. According to the analysis of the decisions of the European Court of Human Rights in the context of this issue, the court called on Ukraine to ensure a fair balance between the interests of agricultural landowners, on the one hand, and the general interests of the community, on the other. This does not mean that the land market should be introduced immediately, but there should be noticeable changes in the process of creation. According to this law, amendments to the Land Code, the Law "On State Land Cadastre", the Law "On Sanctions", the Law "On Notaries", the Law "On State Registration of Real Rights and Encumbrances on Immovable Property", the Law "On State Registration" legal entities, natural persons - entrepreneurs and public formations ”also to the Budget Code of Ukraine. Today, buyers of agricultural land for commercial agricultural production can be citizens of Ukraine, legal entities of Ukraine, the constituent documents of which provide for the conduct of agricultural production. The law also stipulates that in the first three years it will be possible to purchase no more than 100 hectares in one hand. The law specifies a list of entities that are prohibited from acquiring ownership of agricultural land under any circumstances, including if a decision is approved in a referendum. Among them are citizens of the aggressor country, persons who belong or belonged to terrorist organizations. The introduction of the right to buy and sell land requires the adoption of appropriate changes in liability for violations of legislation in this area. Thus, the Law "On Sanctions" will be supplemented by a new type of sanctions - a ban on the acquisition of land
