Conflict of Laws Regulation of Property Relations under law of Ukraine, Switzerland, Hungary and EU

The paper focuses on conflict of laws regulation of property relations under law of Ukraine, Switzerland, Hungary and EU. Conclusions about the necessity of learning of the possibility of use of the experience of Hungary as to determination of the scope of law applicable to property relations and special conflict of laws regulation of rights in rem to components or accessories of the thing have been made. It was found that there is no single instrument in EU law which cover conflict of laws rules governing rights in rem exclusively. At the same time, some tools aimed at conflict of laws regulation of relationships closely connected with rights in rem (like EU Succession Regulation and EU Matrimonial Property Regulation) contain some conflict of laws rules aimed at determination of law applicable to transference of rights in rem in some situation (e.g. in case of death, divorce etc.). These rules allow to figure out some tendencies in conflict of laws regulation in EU law. The main of which is a refusal from division of conflict of laws regulation of movable and immovable things. As a consequence, a traditional connecting factor lex rei sitae is not used in Succession Regulation and Matrimonial Property Regulation. Adaptation of rights in rem is another new tendency in EU Private International Law. Although this institute does not directly refer to conflict of laws regulation, it is closely connected with it, since it provides an opportunity of exercising the rights, which have arisen out of foreign law and are unknown to the law of the country, where a person intends to use them
