Legislative and Practical Aspects of Writing Legal Documents on the Example of Decision on Disability Issues

The article is devoted to the issue of peculiarities of writing legal documents. In particular, it singles out four main points that must be taken into account during the preparation of relevant texts, namely: the inappropriateness of haste, the need to comply with the requirements of the normative design technique and a certain algorithm of actions, the need for a detailed check of the draft legal text. Particular attention is paid to the principles of document preparation defined in the Rules for the preparation of draft acts of the Cabinet of Ministers of Ukraine, in particular: logical sequence, clarity of presentation, absence of contradictions, brevity, correct composition of the draft act, normativity of language means. A peculiar algorithm of actions during the preparation and direct writing of the project of a legal document is characterized, the stages of which include the study of source documents, drawing up the structure of the future document, direct preparation with the involvement of representatives of public associations of persons with disabilities of the text of the document in compliance with the specified requirements for its content. The mentioned material is accompanied by examples of decisions on issues related to the topic of disability, in particular: the laws of Ukraine, the probable structure of the Memorandum between international and national institutions, contradictions regarding the applied terminology (on the example of the introduction of the use of the concept of “person with disabilities” in national legislation) etc. It is important to remember that legislative terminology is dynamic, it is constantly in a state of improvement in connection with the development of legal relations, the establishment of new values or the rethinking of old ones. Yes, even a few years ago, the term “disabled” was widely used. At the same time, thanks to the efforts of civil society, in Ukraine, as in the entire civilized world, it is customary to use the term “person with a disability.” In addition, the concept of “disability” is also inadmissible in relation to such persons. As a result, the term “violation” is used. However, not all legislative acts have been amended accordingly.
