Problems of Determining the Constitutional and Legal Status of the Institute of the President of Ukraine

This article is devoted to investigation of constitutional-legal status of the President of Ukraine. Today Ukraine is in a period of change in political life, what are reflected in society. The political regime in Ukraine during its independence has been changed several times depending on the person held the position of President of Ukraine. Today Ukraine is a parliamentary-presidential republic, meaning that the institution of the President plays an important role among public authorities. Political party that nominated as candidate the current President of Ukraine has received more than half of the seats in Parliament according to the results of the parliamentary elections. This means that the President now has a relationship with the Parliament and similar ideological beliefs. Therefore, determination of capacity and competence arose an urgent problem. Without a clear understanding of the boundaries of the President's activities it may be affected on a mechanism of checks and balances. Analyzed the dependence of the role of the President from the political regime with the examples of foreign countries and the reasons for the establishment in Ukraine of the mixed form of government. The author analyzes the constitutional and legal status of the President in historical perspective, even before Ukraine gained independence, allowing you to track the trend of development of Institute of the President. The article examines how the Ukrainian SSR acts and regulations is already an independent state. Analyzed the participation of the President in the activities of all branches of government and define its place among the legislative, executive and judicial branches of government. In addition, investigated its impact on the defence sector of the country. The author of the article analyzes the provisions of the Constitution of Ukraine in the part relating to the institution of the President. Investigated its functions and tasks, as well as its competence, the possibilities and limits of activities that are defined in the Basic Law
