The case of the ex-Clemenceau showed that légal instruments relating to the conservation of the environment are not adapted to ship dismantling. In order to remedy this legal gap non-compelling directives have been adopted by the Conference of the Parties to the Basel Convention and by IMO. They do not distinguish between warships and civil ships though they should obey different rules. On the one hand, a platform should be created for dismantling warships. On the other hand an international convention should govern the dismantling of civil ships. Such a convention is at the moment being prepared.
