The judgment handed down by the Court of Appeal in Rennes on 13 February 2002, in the case of the shipwreck of the Erika, shows up the inadequacy of a légal framework that does not provide for reparation of damage incurred as a result of accidentai oil pollution. Even though the Court of Appeal held that the application of the Polluter Pays principle could make it possible to complément the international compensation mechanism for victims of pollution, it did not go so far as to provide victims with adequate compensation for their losses by drawing on traditional mechanisms of civil (tortious) liability.
