Réflexions autour de la conception post-moderne du droit

Thoughts upon the Post-Modern Conception of Law. Today, the rationality, effectiveness and legitimacy of law is in question. In order to account for this evolution, some authors call for the development of a new post-modern paradigm. This project, which is also political as it is founded in the desire for a more democratic law, invites us to make an epistemological break. Although such analysis is undoubtedly stimulating, it leaves unanswered several questions concerning the theoretical and practical definition of law as well as the validity of the proposed epistemological break.La rationalité, l'effectivité et la légitimité de la règle de droit posent aujourd'hui problème. Afin de rendre compte de ces évolutions du champ juridique, divers auteurs proposent l'avènement d'un nouveau paradigme post-moderne. Ce projet, également militant puisqu'il s'inscrit dans une volonté de démocratisation du droit, s'incarne dans la notion de complexité, et invite à une rupture épistémologique. Cette analyse, indéniablement stimulante, laisse pour autant certaines questions en suspens, qui concernent aussi bien la conception théorique et pratique du droit que la validité du saut épistémologique proposé.Maisani Pauline, Wiener Florence.
