Introduction à l'article de H. Kelsen

In this introductory article, the author examines the questions of validity and legal interpretation earlier formulated by Hans Kelsen, framing his examination against the background of the contemporary philosophy of law. The author shows that Kelsen 's Pure Theory or Law clearly displays an awareness of the relation between legal validity and its sociological rootedness, as well as an awareness of the relation between the jucucial function and ethical and political concerns.Dans cet article introductif, l'auteur examine les questions de validité et de l'interprétation formulées par Hans Kelsen en les resituant dans le cadre contemporain de la philosophie du droit. Il montre que la Théorie pure du droit révèle une claire conscience du rapport entre la validité d'un ordre juridique et son enracinement sociologique de même qu'entre la fonction de juger, l'éthique et le politique.Coppens Philippe.
