Inheritance and the Peasantry during the French Revolution : A Major Misunderstanding How was peasant opposition to the french Revolution related to the revolutionary legislation that, after several mainly political vicissitudes, resulted in the compromise of the Civil Code ? How did the peasantry experience the transition, which obviously involved laws, from the monarchy to the republic ? How did it react ? The author has distinguished three phases : a) the enactment of new, unitary and egalitarian legislation ; b) reactions ranging from passive resistance to the invention of parrying techniques ; c) the Civil Code. This "brilliant compromise" authorized "both the strictest egalitarianism where it was already usual to practise it and a very marked inegalitarianism in the areas most under the influence of written law".II s'agit dans cet article, partant d'un constat d'opposition paysanne à la Révolution, de déterminer en quoi cette opposition est liée à la législation révolutionnaire, celle-ci aboutissant, après maintes péripéties essentiellement politiques, au compromis du Code civil. Comment le monde paysan a-t-il ressenti le passage de l'Ancien Régime au nouveau et, cette mutation s'étant traduite évidemment par des lois, comment a-t-il réagi ? L'auteur distingue trois étapes : 1) La mise en place de la législation nouvelle, unique et égalitaire (1789-1794). 2) Les réactions : de la résistance passive à l'invention de parades variées. 3) Le Code civil : comment l'on aboutit à ce "compromis génial" qui autorisait "à la fois l'égalitarisme le plus strict là où on avait l'habitude de le pratiquer et un inégalitarisme très prononcé sur les aires les plus influencées par le droit écrit".Goy Joseph.
