Reflexión sobre la evolución histórica del principio de secreto profesional del abogado: el caso español

The right-duty of professional secrecy is one of the fundamental principles of legal ethics. This principle mainly obliges the lawyer not to reveal the confidential data of his clients, especially in the criminal field. Internationally recognized in the world of Law, this figure in our country is regulated in various regulations, among which we can first highlight the Spanish Constitution of 1978 (hereinafter, CE), which recognizes the right of the lawyer not to testify against his defendant. Similarly, the Organic Law of the Judiciary (hereinafter, LOPJ), the Penal Code (hereinafter, CP) of 1995, and especially the General Statute of Spanish Lawyers (hereinafter, EGAE) and the Code of Ethics of the Spanish Lawyers (hereinafter, CDAE).However, to understand the principles on which the current regulations are based, we must know the origins of this general duty of professional secrecy, starting from classical Antiquity (Greece and Rome). The present work tries to delve into these historical antecedents, particularly in the Spanish case.El derecho-deber de secreto profesional es uno de los principios fundamentales de la Deontología jurídica. Este principioobliga principalmente al abogado a no revelar los datos confidenciales de sus clientes, especialmente en el ámbito penal. Reconocido internacionalmente en el mundo del Derecho, dicha figura en nuestro país es regulada en diversas normas, entre las que podemos destacar en primer lugar la Constitución Española de 1978 (en adelante, CE), donde se reconoce el derecho del abogado a no declarar contra su defendido. De igual modo, la Ley Orgánica del Poder Judicial (en adelante, LOPJ), el Código Penal (en adelante, CP) de 1995, y sobre todo el Estatuto General de la Abogacía Española (en adelante, EGAE) y el Código Deontológico de la Abogacía Española (en adelante, CDAE).Sin embargo, para entender los principios en los que se basa la normativa vigente, hemos de conocer los orígenes del deber general de secreto profesional, partiendo de la Antigüedad clásica (Grecia y Roma).
