Pluralismo jurídico en México: lenguas indígenas en la actualidad, lenguas extintas y trascendencia jurídica

The juridical transcendence has great relevance for juridical pluralism in Mexico due to the historical background that constitutes the analysis of the juridical systems of the indigenous communities, the same that determine the qualification of pluricultural to this country and that count with the protection of article 2 of the Political Constitution of the United Mexican States. Likewise, the main tool for the recognition and preservation of the languages of these communities is the General Law of Linguistic Rights of Indigenous Peoples. However, despite this protection, there is evidence of a progressive loss of indigenous languages in terms of their use and customs. In this article, we will analyze this phenomenon from a statistical perspective to demonstrate that one of the factors influencing the loss of indigenous languages is the difficulty of access of their speakers to a good quality of life, since they are forced to leave their communities to acquire the resources they need, for which they must learn the dominant language, leaving their mother tongue in oblivion.La trascendencia jurídica tiene gran relevancia para el pluralismo jurídico en México por los antecedentes históricos que constituyen el análisis de los sistemas jurídicos de las comunidades indígenas, las mismas que determinan el calificativo de pluricultural a este país y que cuentan con la protección del artículo 2 de la Constitución Política de los Estados Unidos Mexicanos. Asimismo, las lenguas de estas comunidades tienen como principal herramienta de reconocimiento y preservación a la Ley General de Derechos Lingüísticos de los Pueblos Indígenas. Sin embargo, a pesar de contar con esta protección, se evidencia una pérdida progresiva de las lenguas indígenas en lo que respecta a su uso y costumbres. En el presente artículo, analizaremos este fenómeno desde una perspectiva estadística para demostrar que uno de los factores que influyen en la pérdida de lenguas indígenas es la dificultad de acceso de sus hablantes a una buena calidad de vida, ya que se ven obligados a salir de sus comunidades para adquirir los recursos que necesitan, para lo cual deben aprender la lengua dominante, dejando en el olvido su lengua madre
