Les services d’intérêt général en droit communautaire entre libre concurrence et État social

The article describes the current EU law framework for the delivery of public services in the Member States of the EU. It aims at demonstrating that two potentially conflicting approaches are currently visible. On the one hand, the EU continues to look at such services from the point of view of unhindered free competition : Governmental interference in the operation of undertakings (e. g. through subsidization) will only be accepted if it is based on a legitimate justification and proportionate. From the point of view of constitutional theory, the relationship between the state and the market is thus fundamentally readjusted. On the other hand, the EU institutions have now accepted the importance of a continuous and uninterrupted delivery of such services of high quality. They are now contemplating about policies and measures that would establish a pan-european standard of public services.Ce texte présente le cadre actuel du droit de l’Union européenne sur les services d’intérêt général des États membres. Il tend à démontrer que deux approches potentiellement conflictuelles se dessinent. D’une part, l’Union européenne (UE) continue à considérer ces services du point de vue d’une totale libre concurrence : l’interventionnisme étatique dans la mise en oeuvre de telles opérations (par exemple au moyen de subventions) ne pourrait être acceptée que sur une base légitime et proportionnée. Du point de vue de la doctrine constitutionnelle, les relations entre l’État et le marché sont ainsi fondamentalement rééquilibrées. D’autre part, les institutions européennes ont maintenant reconnu l’importance du principe de la continuité de tels services de grande qualité. Ils envisagent maintenant une politique et des mesures qui établiraient un modèle pan-européen de service public.Nettesheim Martin.
