Un aperçu de la protection des droits sociaux au Japon

Social rights have been recognized in international law as well as through various domestic laws. However, in comparison to civil and political rights, they are still considered as •half-rights”. Such a differentiated treatment tends to be criticized, by both social movements and doctrinal works, partially followed by international and national jurisprudence. This paper written by Professor Hiroshi Sasanuma, translated into French, offers one among the very few doctrinal works dealing in Japan with the protection of social rights and give a contrasted analysis of the question. If some Japanese legal scholars strongly advocate the indivisibility of human rights, the judiciary still remains hesitant to this regard and judicial decisions are slow to strengthen the •justiciability”, the effectiveness and the opposability of social rights.Quoique reconnus et juridiquement consacrés par de nombreux textes internationaux et de droit interne, les droits sociaux restent traités comme des demi-droits, distincts des droits civils et politiques. Le clivage entre les différents droits fondamentaux tend cependant à être remis en cause, aussi bien par les mouvements sociaux que par une partie de la doctrine, tendance suivie par certains juges, internationaux et nationaux. Comptant parmi le très petit nombre de textes doctrinaux consacrés à la question de la protection des droits sociaux en langue japonaise, l’article du professeur Sasanuma Hiroshi traduit ici offre un aperçu contrasté de la protection des droits sociaux au Japon. S’il témoigne de la volonté d’une partie de la doctrine japonaise de repenser l’indissociabilité des droits de l’homme, le juge japonais y apparaît encore hésitant, ses décisions tardant encore à renforcer la justiciabilité, l’effectivité et l’opposabilité de certains droits sociaux.Sasanuma Hiroshi, Giraudou Isabelle, Malinas David-Antoine.
