Financial sanctions and european constitutional lawThe European way of problem-solving – consistently downgrading political issues to factual ones and addressing them through dialogic, incentive-oriented behavior – has so far failed to produce tangible results in the face of authoritarian tendencies in some member states. The European Union has therefore recently turned to financial sanctions as a more robust means of responding to member state deficiencies in the rule of law: It comes at a cost. Against this backdrop, this article examines the Union law procedure for imposing financial penalties in the context of the more recent revaluation of Article 2 TEU in the jurisprudence of the ECJ
