PERNIKAHAN DI BAWAH UMUR DI DESA KERITANG KECAMATAN KEMUNING KABUPATEN INDRAGIRI HILIR RIAU

Underage marriage is a marriage that does not meet the minimum age limit for marriage as stipulated in Law No. 16 of 2019 concerning Amendments to Marriage Law Number 1 of 1974 concerning Marriage. In the Law, Article 7 Paragraph (1) states that marriage is permitted for women and men when they reach the age of 19 years. In the practice of underage marriage itself, it must have its own reasons for carrying out the marriage, therefore this thesis has a goal which is outlined in a problem formulation to find out how the increase in underage marriage in Keritang village every year, what are the factors driving underage marriage in Keritang village, Kemuning sub-district inhil riau, whether children who enter into underage marriages in Keritang village take marriage dispensation or not, and what are the impacts of underage marriage in Keritang village. In this study, the authors used the field research method, namely by going directly to the field to obtain data related to underage marriage in Keritang Village, Kemuning District, Indragiri Hilir Riau. Meanwhile, this research uses qualitative research with an empirical juridical approach, and the nature of this research is descriptive analytical, where the purpose of the nature of this research is to describe the phenomenon of underage marriage in Keritang Village, Kemuning Subdistrict, Indragiri Hilir Riau.The data collection techniques used by the authors are interviews, documentation conducted at the KUA and the village head's office. Based on the results of the study, it can be concluded that the rate of increase in underage marriage in Keritang village is still relatively high, and if it is presented there is 30% alone for the increase in underage marriage in Keritang village, the relatively high increase is relevant to the population of Keritang village which is the largest among other villages in Kemuning sub-district, where Keritang village reaches more than nine thousand residents, besides that there are several factors that cause underage marriage in Keritang village including, educational factors, economic factors, and parental factors. Not only that, the authors also found three couples who did not apply for marriage dispensation and the reasons described by the three informants were relevant to the above factors, and the impact of underage marriage in Keritang village was the occurrence of separation without divorce, psychological impact, becoming a burden on parents
