Aplicaciones del Ius Puniendi en los contratos estatales regulados por el Derecho Privado

The figure of fines in state contracting is defined as a constraint to the contractor's compliance, which turns him into a debtor that must satisfy a partial and previously defined performance, which was not complied with. This legal figure has the characteristic of being coercive to individuals who act as collaborators of the state in the obligations in the scope and time that the state cannot. For this reason with the issuance of Law 80 of 1993 and subsequent amendment with Law 1150 of 2007 this figure of fines or so-called coercive sanctions, are imposed on contractors in default, according to current regulations which are known as exorbitant clauses. Given this prerogative, it is necessary to ask whether public entities under the contracting regime, what parameters are followed to impose fines or exorbitant powers and apply them? Thus, this research article seeks to analyze the applicability of contractual fines unilaterally by public entities governed by private law on the occasion of total or partial breaches by the other party to the contract.La figura de las multas en la contratación estatal se define como un apremio al cumplimiento del contratista, lo cual lo convierte en un deudor que debe satisfacer una prestación parcial y anteriormente definida, la cual fue incumplida. Esta figura jurídica tiene la característica de ser coercitiva a los particulares los cuales fungen colaboradores del estado en las us obligaciones en el alcance y tiempo que este no puede. Por tal motivo con la expedición de la ley 80 de 1993 y posterior modificación con la ley 1150 de 2007 esta figura de las multas o llamadas sanciones coercitivas, se imponen a los contratistas incumplidos, según la normativa vigente las cuales se les conoce como cláusulas exorbitantes. Ante tal prerrogativa es preciso preguntarse si las entidades públicas bajo el régimen de contratación, ¿qué parámetros siguen para imponer multas o facultades exorbitantes y así mismo aplicarlas?  así las cosas, el presenta artículo de investigación se busca analizar la procedencia de multas contractuales de manera unilateral por parte de las entidades públicas reguladas por el derecho privado con ocasión de los incumplimientos totales o parciales por la otra parte del contrato
