Dès la Constitution de 1824, les débats juridiques autour des droits de l’homme ont pris de l’ampleur au Mexique. Au début, les différents constituants ont vu dans la figure juridique de l’« habeas corpus » anglais une possibilité pour la défense de la liberté des individus. Néanmoins, ils ont constaté l’insuffisance de ce modèle pour la réalité mexicaine du fait que plus de 80% de la population était analphabète.
