El castigo: difícil tarea para la administración de justicia

Within the broad context that implies the analysis of punishment as a legal and social institution, this article mentions only two elements which it considers central, to describe what could be termed the current punishment administration system: prison and the judicial apparatus. It is not the intention of the author to make either an exhaustive analysis of these two figures, or a diagnosis. His main objective is to show, through statistical facts and personal considerations, the issues the current system has to deal with if it wants to stop being the creator of negative situations, which in the final analysis seriously question its efficiency, legality and legitimacy.Dentro del amplio contexto que implica el análisis del castigo como Institución jurídica y social, el artículo menciona solamente dos elementos que se consideran centrales, para describir lo que podría denominarse el actual sistema de administración de la pena y el castigo en Colombia: la prisión y el aparato judicial penal. No es un análisis exhaustivo de estas dos figuras, tampoco un diagnóstico de las mismas. Su objetivo central es evidenciar, a través de algunos datos estadísticos y algunas reflexiones personales, los elementos que tiene que resolver el actual sistema, para dejar de ser generador de situaciones negativas que al final originan problemas que comprometen seriamente su eficacia, legalidad y legitimidad
