Types of Judicial Control over the Activities of Public Administration Bodies in Ukraine and Directions of its Implementation

The article is devoted to the study of the main types and directions of judicial control over the activities of public administration bodies in Ukraine. It was established that the implementation of judicial control over the activities of public administration bodies in Ukraine has many types of manifestations and is carried out in many directions. The directions of implementation of judicial control over the activities of public administration bodies in Ukraine are a reflection of the specifics of the functioning of judicial bodies in the process of implementing various types of such control activities. Special attention is devoted to the analysis of direct and indirect judicial control. General, specialized and constitutional judicial control is characterized. The specifics and peculiarities of previous and subsequent judicial control have been revealed. The analysis of direct and indirect judicial control, which are distinguished by the direction of external influence in the field of public administration, is carried out. Attention is drawn to the division of judicial control into previous and subsequent. It was established that the areas of activity of judicial bodies within the framework of these types of control differ significantly. In the course of preliminary judicial control in the field of public administration, the legality of the application of certain restrictive measures by the public administration body is clarified, and its implementation is carried out within the framework of the same type of proceedings in which the dispute is resolved, but the general goal is not to resolve the public-law dispute in general, but verification of a certain range of public legal requirements. The following judicial control pursues the goal of stopping the illegal activity of the public administration body, stopping the violation of individual rights within the framework of public legal relations, and punishing those guilty of their violation. Special attention is devoted to the scientific discussion regarding the expediency of the normative-legal definition of the institute of preventive administrative action in the KASU. It is emphasized that the application of a preventive lawsuit can serve to improve the quality of legal acts of public administration bodies at the stage of their preparation, to prevent the violation of individual rights, and to restore the possibility of using certain benefits. In this case, the object of the court's exercise of control powers is the adopted illegal acts, decisions, illegal activities, and the basis for initiation is the submission of an administrative lawsuit to the administrative court. Investigating the directions of judicial control over the activities of public administration bodies in Ukraine, it is recognized that its influence affects absolutely all spheres of public legal relations in the state.
