URGENSI PENERAPAN CYBER NOTARY PADA AKTA PENGIKATAN JUAL BELI TANAH DI MASA PANDEMI COVID-19

ABSTRAKAkta Pengikatan Jual Beli Tanah (PJB) umumnya dibuat dengan akta notaris. Proses pengurusan akta PJB di masa pandemi covid-19 saat ini tentu banyak mengalami kendala. Para pihak diwajibkan datang ke kantor Notaris/PPAT untuk membuat akta PJB untuk memenuhi unsur berhadapan langsung dalam akta autentik, namun karena kebijakan pemerintah yang mengharuskan untuk melakukan pyshical distancing dan bekerja dari rumah, maka kantor notaris harus tutup sehingga tidak memungkinkan untuk membuat akta PJB tersebut dengan unsur berhadapan secara langsung. Penelitian ini bertujuan untuk mengetahui urgensi penerapan cyber notary pada akta PJB di masa pandemi covid-19 dan legalitas akta PJB yang dibuat dalam konsep cyber notary di masa pandemi covid-19. Penelitian ini menggunakan metode penelitian hukum normatif melalui metode pendekatan peraturan perundang-undangan. Konsep cyber notary dapat menjadi terobosan baru pada pembuatan akta PJB di masa pandemi covid-19. Melalui cyber notary para pihak tidak perlu lagi datang ke kantor notaris untuk membuat akta PJB melainkan dapat berinteraksi secara virtual melalui media teleconference untuk memenuhi unsur berhadapan langsung. Berdasarkan penjelasan dalam UUJN-P, notaris wajib hadir secara fisik dan menandatangani akta yang dibuatnya di hadapan penghadap dan saksi. Apabila ketentuan itu dilanggar maka akan berdampak pada legalitas akta yakni akta PJB itu akan memiliki kekuatan pembuktian sebagai akta dibawah tangan.Kata kunci: akta pengikatan jual beli tanah; akta notaris; cyber notary ABSTRACT Land purchase and sale agreement (PJB) is generally made with a notary deed. The process of managing PJB deeds during the current covid-19 pandemic is certainly experiencing many obstacles. The parties are required to come to the Notary/PPAT office to make a PJB deed to meet the element of dealing directly in the authentic deed, but because of government policies that require pyshical distancing and working from home, the notary office must close so that it is not possible to make the PJB deed with the element face to face. This research aims to find out the urgency of applying cyber notary to PJB deeds in the covid-19 pandemic and the legality of PJB deeds made in the concept of cyber notary in the covid-19 pandemic. The concept of cyber notary can be a new breakthrough in the creation of PJB deeds during the covid-19 pandemic. Through cyber notary the parties no longer need to come to the notary office to make a PJB deed but can interact virtually through teleconference media to meet the elements face to face. Based on the explanation in UUJN-P, the notary must be physically present and sign the deed he made in the presence of the accuser and witnesses. If the provision is violated it will have an impact on the legality of the deed, namely the PJB deed, it will have the power of proof as a private deed.Keywords: cyber notary; land purchase and sale agreement; notary deed
