El debido proceso administrativo y su vulneración en la solicitud de refugio dentro del estado de excepción

The refuge arises as a protection measure of an international nature, for all those people who had to migrate due to the disastrous events of the Second World War. This figure was ratified by several signatory countries of the United Nations Charter, generating responsibilities in its application. However, with the passing of time, the realities and needs of migrants seeking refuge were changing, much more so at the Latin American level, that is how Colombia became the signatory State of the Cartagena Convention, a norm that adapted the concept of refuge to the realities of the American continent. Although the refuge was consolidated in the Colombian legal system prior to the constitutional change of 1991, the idea of p rotection of migrants goes hand in hand with the concepts of the new Latin American constitutionalism, ensuring that the pre-constitutional norm does not conflict with the new primary norm and the development of the new constitutional rights. These regulatory changes presented at the Latin American level, have allowed prioritizing certain types of rights, among these those of a higher order, and all those that can be classified in this position (constitutionality block), within which due process can be highlighted, guarantee that seeks within the judicial or administrative action of the State, the sufficient elements for a real materialization of access to said services. One of the points of discussion presented arises when the State, as guarantor of these individual rights, can be affected by external or internal, social, political, economic or ecological factors, for which, from the constitutional norm, it is allowed that the same enter a state of exception, where several of these rights can be limited within a temporary period, in order to return to fully guarantee them. The second point to be discussed arises when the rule that allows the application for refugee status proposes extendable terms without limitations, being a clear violation of the principle of speed and the reasonableness of terms, as part of certain main elements of the administrative due process.El refugio surge como una medida de protección de índole internacional, para todas aquellas personas que tuvieron que migrar debido a los acontecimientos de la segunda guerra mundial. Dicha figura fue ratificada por varios países firmantes de la Carta de las Naciones Unidas, generando responsabilidades en la aplicación de ésta. Sin embargo, con el pasar del tiempo, las realidades y necesidades de los migrantes que buscaban refugio fueron cambiando, mucho más a nivel Latinoamericano; específicamente, Colombia se convirtió en el Estado signatario de la Convención de Cartagena, norma que adaptó el concepto de refugio a las realidades del continente Americano. Si bien el refugio fue consolidado en el ordenamiento jurídico colombiano previo al cambio constitucional de 1991, la idea de protección de las personas migrantes, va de la mano de los conceptos del nuevo constitucionalismo Latinoamericano, logrando que la norma pre-constitucional no entre en conflicto con la nueva norma primaria y el desarrollo de los nuevos derechos constitucionales. Estos cambios normativos presentados a nivel Latinoamericano, han permitido priorizar ciertos tipos de derechos, entre estos los del orden superior, y todos los que puedan ser catalogados en esta posición (bloque de constitucionalidad), dentro de los cuales se puede destacar el debido proceso, garantía que busca dentro del actuar judicial o administrativo del Estado, los elementos suficientes para una real materialización de acceso a dichos servicios. El primer punto de discusión presentado surge cuando el Estado como garante de estos derechos individuales, se puede ver afectado por factores externos o internos, sociales, políticos, económicos o ecológicos, para lo cual desde la norma constitucional, se permite que el mismo ingrese en un estado de excepción, donde varios de estos derechos pueden ser limitados dentro de una temporalidad, con el fin de retornar al goce efectivo de los mismos. El segundo punto a discutir, se presenta cuando la norma que permite la solicitud del refugio, plantea términos prorrogables y sin limitaciones, siendo una clara vulneración al principio de celeridad y la razonabilidad de plazos, como parte de ciertos elementos principales del debido proceso administrativo
