NECESSITÀ DI UN UMANESIMO TECNOLOGICO: SISTEMI DI INTELLIGENZA ARTIFICIALE E DIRITTI DELLA PERSONA

The study, recognizing the potential and multiple benefits of Artificial Intelligence in the problem-solving of relevant issues that afflict individuals and the community, focuses on the need to ensure that technology is developed in a human centric perspective. Hence, the proposed idea of a technological humanism that combine AI and civil, social and political rights of individuals, especially the most vulnerable people, in accordance with the guiding principle of the primacy of the human person. The study aims at defining a framework within which to re-build a human centric system, in which private law is called to perform a control function, not merely ordering, but aimed at preserving and promoting humanity, highlighting the immeasurable value that it represents. The analysis pays due attention to the legal aspects and EU remedies and, while proposing a critical point of view of the “Proposal for a Regulation on Artificial Intelligence” (the “Artificial Intelligence Act”), it is positively welcomed, hoping it may ensure a greater centrality to humans in the digital market
