¿Vulnera el Juez de Juzgamiento el principio de imparcialidad en el proceso inmediato?

After the hearing to initiate an immediate process, the trial judge is the same for the accusation control hearing and the oral trial. The objective of this study is to know to what extent the principle of impartiality of the trial judge is affected during the accusation control hearing of the immediate process of those that were carried out in the First Unipersonal Criminal Court of Moyobamba, during the year 2017. For this, we analyzed a sample of 85 files of immediate processes concluded, processed before the First Unipersonal Criminal Court of Moyobamba, during the year 2017, we used the Descriptive-Explanatory method. The most important result of the analysis of the files is that in 74.4% of the files it is incorrect that the person in charge of knowing the accusation control is the preparatory investigation judge. The fact that the regulation of the immediate process allows and establishes that the trial judge knows and carries out the accusation control hearing, inevitably knowing the facts and means of proof, this significantly affects the principle of impartiality of the judges to issue their final decision.Finalizada la audiencia de incoación de un proceso inmediato, el Juez de Juzgamiento es el mismo para la audiencia de control de acusación y el juicio oral. El objetivo de este estudio fue conocer en qué medida afecta el principio de imparcialidad del Juez de Juzgamiento durante la audiencia de control de acusación del proceso inmediato de los que se realizaron en el Primer Juzgado Penal Unipersonal de Moyobamba, durante el año 2017. Para ello analizamos una muestra de 85 expedientes de procesos inmediatos concluidos, tramitados ante el Primer Juzgado Penal Unipersonal de Moyobamba, durante el año 2017. La metodología aplicada fue descriptiva-explicativa. Los resultados demostraron que el 74,4% de los expedientes fue incorrecto que el encargado de conocer el control de acusación sea el Juez de Investigación Preparatoria. El hecho que de que la regulación del proceso inmediato permita y establezca que el Juez de Juzgamiento conozca y lleve a cabo la audiencia de control de acusación, conociendo inevitablemente los hechos y medios de prueba, afecta de manera significativa el principio de imparcialidad de los jueces para la emisión de su decisión final
