The aim of this research is to set what kind of responsibility (administrative or crime) to apply for illegal gaining or holding small amounts of drugs without the purpose of its selling or other distribution in Lithuania. The paper analyzes administrative and crime responsibility for illegal gaining or holding small amounts of drugs without the purpose of its selling or other distribution in Lithuania. The analysis is made on the basis of systematic interpretation of law, besides it is invoked the practice of European court of human rights. The paper presents the methodology that may help to evaluate what kind of responsibility (administrative or crime) to apply for illegal gaining or holding small amounts of drugs without the purpose of its selling or other distribution
