El bitcoin y su tributación

The purpose of this paper is an analysis of the tax treatment of bitcoin as well as any tax consequences that may be the emergence of the virtual currency. Indeed, in recent months, the mainstream media and the press have been filled with news about the bitcoin, which gives an idea of the importance that the instrument is acquiring in the world economy. In this sense, the tax field is no stranger to this phenomenon generated by the introduction of bitcoin in the markets. That causes the need to think about the tax treatment of this virtual currency. This paper will examine the legal nature and its tax treatment in the Spanish tax system from the strict point of view of the current positive law, dealing the issue with rigor and seriousness, ignoring both subjective ratings.El objeto del presente trabajo es efectuar un análisis del tratamiento fiscal del bitcoin así como de las eventuales consecuencias que para la fiscalidad puede tener la irrupción de dicha moneda virtual. En efecto, en los últimos meses, tanto los medios de comunicación generalistas como la prensa especializada se han venido llenando de noticias relativas al bitcoin, lo que da una idea de la relevancia que dicho instrumento está adquiriendo en la economía mundial. En este sentido, el ámbito tributario no ha sido ajeno a dicho fenómeno, generando la introducción del bitcoin en los mercados la necesidad de reflexionar sobre el tratamiento fiscal de esta moneda virtual. Así, el presente trabajo analizará la naturaleza jurídico-tributaria del bitcoin y su encaje en el sistema tributario español desde el estricto punto de vista del Derecho positivo actual, intentado abordar la cuestión con rigor y seriedad, obviando las valoraciones tanto subjetivas como objetivas que pueda merecer dicho instrumento
