This chapter analyses how Italy has implemented the duty to criminalise war crimes in the Italian domestic legal system. The analysis addresses the obligations of domestic criminalisation incumbent upon Italy in the field of war crimes, the extant implementing legislations (with all its shortcomings), and the role of the constitutionally protected principle of legality in this matter. Other related issues – such as the rules governing the exercise of Italian jurisdiction over war crimes – are outside the purview of this study
