ESTÁNDARES INTERAMERICANOS SOBRE EL DERECHO DEL NIÑO A SER OÍDO EN PROCESOS JUDICIALES

The interpretation and application of the guiding or governing principles of the Convention on the Rights of the Child, is of the utmost importance in the intervention of the child in judicial processes, since the non-consideration of these principles could mean the violation of rights recognized in the Convention, which in turn will bring harmful consequences for the life and development of the child. Therefore, the objectives of this paper are to identify the guiding principles or guidelines of the Convention on the Rights of the Child, in order to later determine how the Inter-American Court of Human Rights has interpreted and applied these principles in specific cases, and thus specify which one, are the international standards on the intervention of the child in judicial proceedings, in accordance with the rulings of the Inter-American Court of Human Rights.La interpretación y aplicación de los principios guía o rectores de la Convención sobre derechos del niño, es de suma relevancia en la intervención del niño en procesos judiciales, ya que la no consideración de estos principios podría significar la vulneración de derechos reconocidos en la Convención, que traerá a su vez consecuencias perjudiciales para la vida y desarrollo del niño. Por lo anterior, los objetivos del presente trabajo son identificar los principios rectores o guías de la Convención sobre derechos del niño, para luego determinar de qué manera la Corte Interamericana de derechos humanos ha interpretado y aplicado estos principios en casos concretos, y así precisar cuáles son los estándares internacionales sobre la intervención del niño en procesos judiciales, de conformidad a los fallos de la Corte Interamericana de Derechos Humanos
