ESTATUTO DA CIDADE E PLANO DIRETOR: CONVERGÊNCIAS E DIVERGÊNCIAS. ESTUDO DE CASO DO MUNICÍPIO DE NOVA FRIBURGO / RJ

The longstanding territorial urban planning is the focus of shares of public power. The Statute of cities, which regulates the articles of the federal constitution dealing with urban policy, has been considered by some scholars, one of the major legal developments in terms of management and urban planning in Brazil. In its section I, The Status of cities poses as one of the instruments of territorial urban planning at the municipal level, the plan director. This, in turn, in legal terms, has to be a tool toward the exclusive management of urban areas, despite its radius of action, in some municipalities, covering urban areas and non-urban - rural areas. At this point, the question is: How this tool incorporates the demands of management and environmental conflicts inherent in the territories as individuals, not urban, but inherently embedded in the configuration of the urban network and who see suffering multiple and different pressures of the environment, urban logic? It is believed that promoting the participation of the whole population, are of non-urban or urban areas, can lead this instrument to address its central purpose, which is driving the urban land to meet its social function, the extent this instrument can contribute to reducing social inequalities and territorial, to redistribute the risks and benefits of urbanization. In that sense, and Monken Barcellos (2007), argue that the fundamental objective is to establish how the property will meet its social function in order to ensure access to urban land and settled, recognize that all citizens the right to housing and urban services in anticipation of becoming an instrument that makes the design sustainable development of the Brazilian cities. This article brings in a first part a brief presentation of theoretical precepts and the legal bases and structuring of this instrument of urban territorial management. Later it will submit the plan director of the city of Nova Friburgo, in order to verify that this document compliance guidelines for its document of regulation, the Statute of the City.A longa data o planejamento territorial urbano é foco de ações do poder público. O Estatuto das Cidades, que regulamenta os artigos da constituição federal que tratam da política urbana, tem sido considerado, por alguns estudiosos, um dos maiores avanços legais em termos de gestão e planejamento urbano no Brasil. Em sua seção I, O Estatuto das Cidades coloca como um dos instrumentos do planejamento territorial urbano, ao nível municipal, o plano diretor. Este, por sua vez, em termos legais, vem a ser uma ferramenta voltada para a gestão exclusiva de áreas urbanas, apesar de seu raio de atuação, em alguns municípios, abarcar áreas urbanas e não-urbanas – áreas rurais. Nesse ponto, reside o questionamento: Como esta ferramenta de gestão incorpora as demandas e conflitos ambientais inerentes a territórios tão particulares, não urbanos, mas intrinsecamente inseridos na configuração da rede urbana e que vêem sofrendo múltiplas e distintas pressões do meio, da lógica urbana? Acredita-se que a promoção da participação do conjunto da população, sejam de áreas urbanas ou não urbanas, possa conduzir este instrumento a contemplar seu objetivo central, que é o conduzir o solo urbano a cumprir sua função social, a medida em este instrumento possa contribuir para redução das desigualdades sociais e territoriais, ao redistribuir os riscos e benefícios da urbanização. Nesse sentido, Barcellos e Monken (2007), afirmam que o objetivo fundamental é estabelecer como a propriedade cumprirá sua função social, de forma a garantir o acesso à terra urbanizada e regularizada, reconhecer a todos os cidadãos o direito à moradia e aos serviços urbanos na perspectiva de tornar-se um instrumento que introduz a concepção de desenvolvimento sustentável às cidades brasileiras. O presente artigo traz, em uma primeira parte uma breve apresentação dos preceitos teóricos e as bases legais e estruturação deste instrumento de gestão territorial urbana. Posteriormente apresentar-se-á o plano diretor do Município de Nova Friburgo, com o intuito de verificar se este documento cumpri as diretrizes de seu documento de regulamentação, o Estatuto da Cidade
