RACISMO E INJÚRIA RACIAL: MUDANÇA JURISPRUDENCIAL NO CASO HERALDO PEREIRA

The paper analyzes the crimes of racism and racial injury in the light of the Paulo Henrique Amorim vs Heraldo Pereira case, which equated the respective criminal types. Through content analysis of the magistrates' speeches, it is a critical study of the behavior of the judiciary in the light of the normative framework designed to combat racism and to protect black people in the criminal sphere. In this sense, the objective was to understand the advances and limits of that decision in view of criminal dogmatics and the critical study of race relations and whiteness in Brazil. The research found that, despite the improvement in jurisprudence, the case corroborates a precarious reality of protection of the black population by the justice system. Specifically, in the context of criminal protection, it noted the reinforcement of the idea of the crime of racism without crime and criminal.O artigo analisa o tratamento jurídico dos crimes de racismo e injúria racial à luz do caso Paulo Henrique Amorim vs. Heraldo Pereira. Esse precedente fixou o entendimento de que o rol da Lei do Crime de Racismo (7.716/89) não é taxativo e abarca a injúria racial, tornando-a imprescritível e inafiançável. Com o uso da dogmática penal, da crítica ao racismo e dos estudos da branquidade, objetivou-se compreender os avanços e os limites da sentença. A metodologia utilizada foi a análise de conteúdo dos discursos dos magistrados, atentando-se, especialmente, aos efeitos do silêncio e à relativização do racismo. A pesquisa verificou que, a despeito da melhora jurisprudencial, o caso corrobora uma realidade precária de proteção da população negra por parte do poder judiciário. Particularmente no âmbito da tutela penal, a decisão reforça a ideia do delito de racismo sem crime e criminoso.
