O PAPEL DAS LEIS NO COMBATE À GRIPE ESPANHOLA: : NASCIMENTO DE UM CÓDIGO SANITÁRIO?

This paper investigates discourses in the public debate on health legislation during the Spanish flu epidemic in Rio de Janeiro, then capital of the Republic. The research methodology involved a documental analysis of National Congress diaries and periodicals with wide circulation in the capital, aiming to understand the institutional context and public opinion during the most acute period of the epidemic, as well as a review of the historiographic literature on the influenza and on epidemics in Brazil. The work's hypothesis is that the crisis created by the pandemic caused the emergency by consolidating the health laws into a statutory code. The conclusion reached by the article is that, at the time of the spread of influenza in the federal capital, there was no structure or public health policy built to serve the population, not even an ongoing health project to propose solutions to the pandemic.  Este artigo investiga discursos no debate público sobre a legislação sanitária durante a epidemia de gripe espanhola no Rio de Janeiro, então capital da República. A metodologia da pesquisa envolveu a análise documental dos diários do Congresso Nacional e de periódicos de grande circulação na capital, visando à compreensão do contexto institucional e da opinião pública durante o período mais agudo da epidemia, além de uma revisão da literatura historiográfica sobre a gripe espanhola e as epidemias no Brasil. A hipótese do trabalho é a de que a situação de crise criada pela pandemia causou a emergência por uma consolidação das leis sanitárias em um código. A conclusão a que chega o artigo é a de que não havia, à época da disseminação da influenza na capital federal, estrutura ou política pública de saúde construída para atender à população nem sequer projeto sanitário em curso para propor soluções para a pandemia. &nbsp
