Analisis Yuridis Perlindungan Hak-Hak Bagi Pekerja Yang Di Phk Secara Sepihak Karena Adanya Wabah Covid-19 Dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan Di PT. Asuransi Raksa Kota Pekanbaru

ABSTRACT Juridical analysis of the protection of rights for workers who have been dismissed unilaterally due to the COVID-19 outbreak in Law Number 13 of 2003 concerning Manpower in which employers do not fulfill their obligations to workers who have been laid off, causing a dispute so that the entrepreneur can fulfill their obligations. The main problem in this research is how to provide legal protection for workers who are laid off unilaterally due to the COVID-19 outbreak in Law No. 13 of 2003 concerning employment and how to resolve industrial relations disputes at PT. Asuransi Raksa in Pekanbaru City. This study uses a sociological legal research method (empirical) or (observational research) which is descriptive analytical by means of a survey, the location chosen in this study is PT. Asuransi Raksa Pekanbaru city, Riau Province, researchers conducted interviews with employees and the company as respondents in this study. The results of the research in this paper can be concluded that the legal protection for workers who are laid off unilaterally due to the COVID-19 outbreak in Law Number 13 of 2003 concerning Employment at PT. Pekanbaru City Insurance has not been implemented as mandated by the law, namely termination of employment which must be agreed upon by both parties and the provision of company obligations to workers affected by termination of employment. As for the settlement of industrial relations disputes at PT. Pekanbaru City Insurance, according to Law No. 13 of 2003 concerning Manpower, has not yet found a bright spot, until now it is still in the process of resolving which seeks for both parties to resolve disputes by deliberation to reach consensus
