La constitucionalización del derecho civil: un camino al equilibrio

What is the influence that Constitutional Law currently has on Civil Law in Peru of the Bicentennial? Does the constitutionalization of Civil Law imply greater guarantees for the exercise of rights or does it mean greater limits to private autonomy? In this article, the author analyzes the influence that Constitutional Law has on Civil Law, from the guiding framework that it grants, as well as the limits that it establishes. Likewise, it revalues the interconnectivity that all legal science must have with Constitutional Law. It should be noted that, currently in Peru, various unconstitutional laws have been enacted; evidencing the little importance that legislators give to our Magna Carta. For this reason, the author considers imperative to ratify the primacy of the Constitution and its guarantor, pacifier and balancing role.¿Cuál es la influencia que posee en la actualidad el derecho constitucional en el derecho civil en el Perú del bicentenario? ¿La constitucionalización del derecho civil supone mayores garantías para el ejercicio de derechos o significa mayores límites a la autonomía privada? En el presente artículo, el autor analiza la influencia que posee el derecho constitucional en el derecho civil desde el marco rector que otorga, así como los límites que traza. Asimismo, revalora la interconectividad que toda ciencia jurídica debe poseer con el derecho constitucional. Cabe destacar que, en la actualidad peruana, diversas leyes inconstitucionales han sido promulgadas, lo cual evidencia la poca importancia que los legisladores otorgan a nuestra carta magna. Por ello, el autor considera imperativo ratificar la primacía de la Constitución y su rol garantista, pacificador y de equilibrio
