La question des droits de l'Homme dans la mise en œuvre de l'accord d'association entre la Tunisie et l'Union Européenne

Though it is an international agreement with economic and commercial purposes, the association agreement between Tunisia and the European Union, signed on 17th July 1995 and entered into force on 1st March 1998, made the human rights clause of its article 2 the key point of the parties' commitment. As part of a Euro-Mediterranean partnership process launched in Barcelona, the European Union intends to establish itself as a global player whose foreign policy would be based on the promotion and respect of human rights.This thesis examines the legal aspects of the human rights issue in the implementation of the Association Agreement between Tunisia and the European Union through a global and transversal approach, in particular following the revolution that occurred in Tunisia on 14th January 2011 and the transition to the second Republic of Tunisia. The study proposes to go beyond the traditional division between internal and external protection areas, in order to analyse the dynamics between the legal conception of a “human rights” conditionality, starting from the study of the evolution of institutional, normative and political frameworks in the implementation of the Tunisia-EU Association Agreement. By a critical and pragmatic method, the research has allowed the treatment of the problem regarding the ambiguities of the normative logic of the European approach as a legal policy of projection of its values. This results in a mixed practice of different mechanisms to guarantee human rights under the Association Agreement, with regard to a variable geometry application of the conditionality of Article 2 of the Agreement as well as the permanence of extra-legal issues. This situation constantly requires a redefinition of the partnership’s approach so that the issue of human rights is not merely a projection or outsourcing of the EU’s internal policies. Besides, the clarification of the normativity of the implementation of the « Human Rights » conditionality appears therefore as an inescapable requirement, especially with the new era of the partnership and the granting of a privileged partner status to post-revolution Tunisia. What is at stake is the visibility of the European Union’s external action as a legal entity, defined as a “normative power”, capable of efficiently influencing the content and application of the rules of international human rights law.L’accord d’association entre la Tunisie et l’Union européenne, signé le 17 juillet 1995 et qui est entré en vigueur le 1er mars 1998, bien qu’il s’agisse d’un accord international à vocation économique et commerciale, a fait de la clause du respect des droits de l’Homme de son article 2 l’ « élément essentiel » de l’engagement des parties. Dans le cadre d’un processus de partenariat euroméditerranéen lancé à Barcelone, l’Union européenne entend s’imposer comme acteur global dont la politique extérieure serait fondée sur la promotion et le respect des droits de l’Homme. Cette thèse examine les aspects juridiques de la question des droits de l’Homme dans la mise en œuvre de l’accord d’association entre la Tunisie et l’Union européenne à travers une approche globale et transversale, notamment suite à la révolution survenue en Tunisie le 14 janvier 2011 et le passage à la deuxième République tunisienne. L’étude propose le dépassement de la division traditionnelle entre les domaines de protection interne et externe, afin d’analyser la dynamique de la conception juridique d’une conditionnalité « droits de l’Homme », à partir de l’étude de l’évolution des cadres institutionnel, normatif et politique dans la mise en œuvre de l’accord d’association Tunisie-UE. Par une méthode critique et pragmatique, la recherche a permis le traitement de la problématique relative aux ambiguïtés de la logique normative de la démarche européenne en tant que politique juridique de projection de ses valeurs. Il en ressort une pratique mitigée de différents mécanismes de garantie des droits de l’Homme en vertu de l’accord d’association, au regard d’une application à géométrie variable de la conditionnalité de l’article 2 de l’accord et de la permanence des enjeux extra-juridiques. Cette situation impose constamment une redéfinition de l’approche du partenariat de façon à ce que la question des droits de l’Homme ne soit pas une simple projection ou externalisation des politiques internes de l’UE. De surcroît, la clarification de la normativité de la mise en œuvre de la conditionnalité « droits de l’Homme » apparait dès lors comme une exigence indispensable, notamment avec la nouvelle ère du partenariat et l’octroi d’un statut de partenaire privilégié à la Tunisie post-révolution. Il en va de la visibilité de l’action extérieure de l’Union européenne en tant qu’entité juridique, définie comme « puissance normative », capable d’influer efficacement sur le contenu et l’application des règles de droit international des droits de l’Homme
