Analysis of the Convention of the Council of Europe on preventing and combating violence against women and domestic violence. Throught the cases of study of Portugal, Finland, Sweden, Latvia, and Turkey.

El convenio del Consejo de Europa sobre la prevención y lucha contra la violencia contra las mujeres y la violencia doméstica es un mecanismo de carácter vinculante establecido desde 2011 que busca proteger a las mujeres contra todos los tipos de violencia, en los países pertenecientes al Consejo Europeo. El convenio brinda las bases para la creación e implementación de nuevas leyes, políticas y herramientas que vayan encaminadas no solo a la eliminación de la violencia contra la mujer, sino a la eliminación de los roles de género y a la protección de todas las víctimas. Tras haberse conmemorado 10 años de la realización del Convenio, este trabajo busca investigar ¿de qué manera El Convenio de Estambul ha sido un punto de inflexión en la creación de políticas y herramientas encaminadas a la eliminación de la violencia basada en género contra las mujeres?. Para este objetivo se realizó un análisis a los tres Estados que han implementado el convenio, estos son Suecia, Finlandia y Portugal; también se estudió el caso de Letonia, un país que firmó el Convenio pero no lo ratificó, por lo que no ha sido implementado; finalmente se analizó el caso de Turquía, país que implementó el Convenio pero lo abandonó en 2021. Este trabajo encontró que, en los países que se ha implementado el Convenio, ha habido grandes avances en termino de creación de políticas, sin embargo, aún hay falencias en la implementación, especialmente con respecto a la interseccionalidad. Se llegó a la conclusión que el caso de Letonia y Turquía muestran las falencias del Convenio en aspectos como su cosmovisión.Consejo EuropeoThe Convention of the Council of Europe on preventing and combating violence against women and domestic violence is a binding mechanism established in 2011, that aims to protect women against all forms of violence in the Member States of the Council of Europe. The Convention provides the basis for the creation and establishment of new policies, laws, and tools for both, the elimination of violence against women and the protection of all the victims, and the elimination of gender roles. After having commemorated ten years of the implementation of the Convention, this paper aims to investigate How the Istanbul Convention has been a turning point in the creation of policies and tools aimed to eliminate gender-based violence against women? For accomplishing this objective, an analysis of three States that have implemented the Convention was carried out, these are Sweden, Finland, and Portugal. Additionally, the case of Latvia was also studied, a country that signed the Convention but did not ratify it, meaning it has not implemented it; Finally, the case of Turkey was analyzed, a country that implemented the Convention but abandoned it in 2021. This paper found that in the countries that have implemented the Convention, there have been significant advances in terms of creating policies, however, there are still shortcomings in the implementation, especially concerning intersectionality. It also was concluded with the cases of study of Latvia and Turkey, that the Convention has shortcomings related to its worldview.InternacionalistaPregrad
