Pamięć narodowa a relacje międzynarodowe Polski

The study is devoted to the issue of the concept and protection of national memory in Polish law. It considers how the protection of historical memory is organised in the institutional scope, from the Main Commission for the Study of German Crimes in Poland and its evolution to the Institute of National Remembrance — the Commission for the Prosecution of Crimes against the Polish Nation. It presents the tasks assigned to these institutions. The authors reflect on the notion of the “official version of history,ˮ which has competing versions in the area of other national memories, and on how the existence and legal protection of these national versions may affect relations with other states protecting those competing versions. Finally, the paper discusses the issues of criminal law protection of national memory — its very meaning and appropriate instruments in the form of creating types of crimes that penalise behaviours directed against state-formed memory (the official version of history). The subject of analysis is Polish criminal law and subsequent attempts to introduce such types of crimes into the criminal code. According to the authors, criminal law is not a good instrument for the protection of national memory for two fundamental reasons. Firstly, regardless of the formulation of a specific penal provision and its interpretation, it limits the freedom of historical research. Secondly, introducing this type of crime affects relations with those countries that protect other competing versions of official history.Opracowanie poświęcone jest zagadnieniu pojęcia i ochrony pamięci narodowej w polskim prawie. Rozważana jest w nim organizacja ochrony pamięci historycznej w zakresie instytucjonalnym, poczynając od Głównej Komisji Badania Zbrodni Niemieckich w Polsce i jej ewolucję, a na Instytucie Pamięci Narodowej — Komisji Ścigania Zbrodni przeciwko Narodowi Polskiemu kończąc. Przedstawiane są tu zadania przypisane tym instytucjom. Autorzy zastanawiają się nad pojęciem „oficjalnej wersji historii”, które w obszarze innych pamięci narodowych ma wersje konkurencyjne, i nad tym, jak istnienie i prawna ochrona tych wersji narodowych może wpływać na relacje z innymi państwami chroniącymi owe konkurencyjne wersje. Wreszcie w pracy omawiane są kwestie prawnokarnej ochrony pamięci narodowej — samego jej sensu i właściwych instrumentów w postaci tworzenia typów przestępstw penalizujących zachowania skierowane przeciwko kształtowanej przez państwo pamięci (oficjalnej wersji historii). Przedmiotem analizy jest polskie prawo karne i kolejne próby wprowadzania do kodeksu karnego takich typów przestępstw. Zdaniem autorów prawo karne nie jest dobrym instrumentem ochrony pamięci narodowej z dwóch zasadniczych względów. Po pierwsze, niezależnie od sformułowania konkretnego przepisu karnego i jego interpretacji wpływa on na ograniczenie wolności badań historycznych.
