Derechos fundamentales y drittwirkung en perspectiva multinivel: desarrollos recientes en el derecho europeo

This paper adopts as its starting hypothesis the positive impact of the Drittwirkung doctrine as the basis of an expanding European constitutionalism aiming at strengthening the multi-level protection of fundamental rights. In this respect, recent developments in this field in European law are examined, particularly in the case-law of the European Courts in Strasbourg (Council of Europe) and Luxembourg (European Union). Thus, the first part recalls the way in which this German doctrine has been imported and consolidated in comparative constitutionalism, including the Spanish Constitutional Jurisdiction since its first rulings. The second part analyses the direct horizontal effect in the evolutive case-law of the European Court of Human Rights, mainly through the notion of positive obligation. The third part criticises the restrictive approach of the European Court of Justice to the Drittwirkung theory. The last part scrutinises recent European case-law developments on Drittwirkung by arguing that the restrictions arising from the respective human rights instruments (material scope of the European Convention on Human Rights, distribution of competences between the EU and Member States, or the distinction between principles and rights in the Charter of Fundamental Rights) should not be an obstacle, on the one hand, to reconsider the rejection of the horizontal direct effect of some rights (especially the Court of Justice in relation to the social rights recognised in the EU Charter) and, on the other hand, to improve synergies between the two European Courts, without forgetting the interaction with other European and international human rights standards in the search for the best attainable solution for human dignity. Ultimately, modern trends in multi-level constitutionalism mean that Drittwirkung and favour libertatis/pro personae principle must go hand in hand. Summary:1. CONCLUSIONS: INTERPRETATIVE SYNERGIES IN FAVOUR OF THE PROTECTION OF FUNDAMENTAL RIGHTS IN HORIZONTAL RELATIONS.La presente contribución adopta como hipótesis de partida el impacto positivo de la doctrina de la Drittwirkung como base de un constitucionalismo europeo en expansión tendente a reforzar la protección multinivel de los derechos fundamentales. En este sentido, se examinan los desarrollos recientes en dicho ámbito en el Derecho Europeo, particularmente en la jurisprudencia de los Tribunales Europeos de Estrasburgo (Consejo de Europa) y de Luxemburgo (Unión Europea). Así, en la primera parte se recuerda el modo en que esa doctrina alemana ha sido importada y consolidada en el constitucionalismo comparado, incluida la Jurisdicción Constitucional española desde sus primeras sentencias. En la segunda parte se analiza el efecto horizontal directo en la jurisprudencia evolutiva del Tribunal Europeo de Derechos Humanos, principalmente a través de la noción de obligación positiva. En la tercera parte se somete a crítica la restrictiva aproximación a la teoría de la Drittwirkung por parte del Tribunal de Justicia de la Unión Europea. En la última parte se someten a escrutinio los desarrollos recientes de la jurisprudencia europea sobre la Drittwirkung, argumentándose que las restricciones derivadas de los respectivos instrumentos de derechos humanos (ámbito material del ConvenioEuropeo de Derechos Humanos, distribución de competencias entre UE y Estados miembros, o distinción entre principios y derechos en la Carta de los Derechos Fundamentales) no deben ser obstáculo para, de un lado, reconsiderar el rechazo a la eficacia horizontal directa de algunos derechos (especialmente, el Tribunal de Justicia en relación con los derechos sociales reconocidos en la Carta de la UE) y, por otro lado, mejorar las sinergias entre ambas Cortes Europeas, sin olvidar la interacción y diálogo con otros estándares europeos e internacionales en el ámbito de los derechos humanos en la búsqueda de la solución más favorable para el respeto de la dignidad.
