This paper adopts as its starting hypothesis the positive impact of the Drittwirkung doctrine as the basis of an expanding European constitutionalism aiming at strengthening the multi-level protection of fundamental rights. In this respect, recent developments in this field in European law are examined, particularly in the case-law of the European Courts in Strasbourg (Council of Europe) and Luxembourg (European Union). Thus, the first part recalls the way in which this German doctrine has been imported and consolidated in comparative constitutionalism, including the Spanish Constitutional Jurisdiction since its first rulings.
