Indonesia Peluang Emas Pemenuhan HAM Melalui Demokrasi: Analisis Komparatif Rezim Pemerintahan di Filipina

Human rights compliance and implementation are determined by various factors, both material and non - material, including democracy. This statement is based on the fact that democracy stands as a media to channel people’s aspirations. Furthermore, democracy also upholds individual liberty. This paper argues that democracy becomes one of the crucial factors in human rights fulfillment, protection, and implementation of a country. Through the method of literature study, a comparative analysis will be made to examine two government regimes in the Philippines, Ferdinand Marcos and Corazon Aquino, respectively. The discussion starts with a general overview of democracy, followed by elaboration of Ferdinand Marcos and Corazon Aquino governance as the main focus of this paper. In addition, the role of Transnational Advocacy Network (TAN) as a non-state actor will be further explained as one of the key factors of sustainability of human rights practice in the Philippines. To end the discussion, a deeper analysis will re-emphasize that democratic governance gives more guarantee to human rights fulfillment in the Philippines with some addition of possible solutions to ensure human rights protection in the regime of Ferdinand Marcos Jr. as the new president of Philippines. The result of this article shows that human rights implementation, especially in the Philippines, is highly dependent on the democracy system itself with the nascence and participation of Transnational Advocacy Networks (TAN) struggle in human rights. Hal ini berlandaskan pada fakta bahwa demokrasi menjadi sarana penampung aspirasi rakyat di suatu negara. Tidak hanya itu, demokrasi juga menjunjung tinggi kebebasan individu. Tulisan ini berargumen bahwa demokrasi menjadi faktor penting dalam pemenuhan, perlindungan, dan implementasi HAM di suatu negara. Melalui studi pustaka, akan dilakukan analisis perbandingan terhadap dua rezim pemerintahan di Filipina, yaitu Ferdinand Marcos dan presiden selanjutnya, Corazon Aquino. Pembahasan tulisan ini akan dimulai dengan pemaparan pandangan umum mengenai demokrasi. Kemudian dilanjutkan dengan deskripsi pemerintahan Presiden Ferdinand Marcos dan Presiden Corazon Aquino yang akan menjadi fokus studi komparatif dari tulisan ini. Peranan transnational advocacy network (TAN) sebagai non-state actor dalam keberlangsungan HAM melalui demokrasi di Filipina juga akan dijelaskan. Pembahasan akan ditutup dengan analisis justifikasi pada pemerintahan Presiden Corazon Aquino yang benar menunjukkan bahwa pemerintahan yang demokratis lebih menjamin terpenuhinya HAM di Filipina disertai dengan solusi yang dapat dilakukan untuk menjamin pemenuhan HAM di era pemerintahan Ferdinand Marcos Jr. Hasil analisis tulisan ini menyimpulkan bahwa pemenuhan HAM di suatu negara, termasuk di Filipina, sangat bergantung pada sistem demokrasi yang dibuktikan dengan kelahiran beberapa Transnational Advocacy Network (TAN) yang memperjuangkan HAM di negara tersebut.
