Justices d’Église en Provence (milieu du XIIe - milieu du XIVe s.)

Different Types of Church Justice in Provence (mid-12th-mid-14th Century). As far as 12th-14th century Provence is concerned, the different types of religious justice are still a relatively uncharted area of research. They are mainly known through their relations with county authorities. During the period concerned, the temporal justice of the clergy underwent a spatial containment : it was excluded from the larger urban municipalities, but consolidated in certain castra It was also integrated into the Angevine judicial structure, particularly through the Prince’s discourse on regalia and the establishment of a complex system of appeal. Church justice was characterised by a phase of procedural but also doctrinal elaboration, in which local prelates such as Henry of Susa actively participated. The development of procedure was initiated by measures taken by local concils against heresy. Since the sources regarding the officiliaties before the end of the 14th century are scarce, their history and that of the social background and of the education of the officials still has to be written.Les justices d’Église constituent pour la Provence des XIIe-XIVe s. un domaine de recherche encore peu jalonné. Elles sont surtout connues dans leurs relations avec le pouvoir comtal. En effet, la période voit la justice temporelle des hommes d’Église connaître un endiguement spatial, par son exclusion des grandes agglomérations urbaines accompagnée par sa consolidation dans certains castra, et une intégration dans l’édifice judiciaire angevin, en particulier à travers le discours du prince sur les regalia et l’instauration d’un système complexe d’appels. Quant à la justice spirituelle, elle connaît une phase d’élaboration doctrinale, à laquelle participent activement des prélats locaux, tel Henri de Suse, et procéduriale, après des préoccupations perceptibles dans les dispositifs conciliaires et initialement marquées par la lutte contre l’hérésie. L’histoire des officialités ainsi que du milieu et de la formation des officiaux reste toutefois à écrire, ce tribunal n’étant véritablement documenté qu’à partir de l’extrême fin du XIVe s.Pécout Thierry.
