La pratique du conseil devant l’Inquisition (1323-1329)

Counselling during the Inquisition (1323-1329). The practice of the consultation of experts by Inquisition courts has not been studied in depth although archive documents abound, offering an original prospect on the inquisitorial system. One of its characteristics comes from its positioning, at the same time partially metajuridical (by its constant reference to the requirements of conscience and its real concern with social representativeness) and definitely jurisdictional. Coming shortly before the sentence, the consultations required by the inquisitor gave the opportunity to check the procedure, which could even at times be censured retrospectively. In that regard, the corrective action of the consultation made it possible to ensure a greater effectiveness of the procedure and a wider tolerance of its effects by the society. Lastly, because of ideology (i.e. the medieval ideal of harmony) and pragmatism (i.e. concern for giving authority to the counsel), counselling to Inquisition courts appears to have brought about unanimity. For that reason, it was one of the best expressions of the consensual dimension the court of faith intended to give their fight against heresy.La pratique de la consultation d’experts par les tribunaux d’inquisition a été peu étudiée, alors qu’il s’agit d’une source assez bien documentée, offrant une perspective originale sur le fonctionnement du système inquisitoire. L’une de ses particularités tient à son positionnement, à la fois partiellement métajuridique (par sa référence constante aux impératifs de la conscience et son réel souci de représentativité sociale) et nettement juridictionnel. Précédant de très peu le jugement, les consultations requises par l’inquisiteur étaient en effet l’occasion d’un contrôle a posteriori de la procédure, voire, exceptionnellement, d’une censure de celle-ci. A ce titre, l’action corrective du conseil permettait d’assurer une plus grande efficacité de la procédure, mais aussi une meilleure tolérance sociale de ses effets.
