El Derecho de Autor y los recursos educativos abiertos

Introduction: copyright law and related rights or the similar are components of the intellectual property. They protect the creations expressed in literary, musical, scientific and artistic works. In the XX century it was universally recognized as a human right; with the development of information technologies, telecommunications and Internet, it takes on new dimensions in accordance with the media in which the works are used.Objective: to reflect on copyright law and the use of open educational resources considering their contribution to knowledge by professionals and authors of intellectual productions.Development: the ignorance about the copyright law for professionals belonging to different branches of knowledge can result in plagiarism; to avoid it there are mediating institutions which guarantee the originality of the created works. The work agglutinates the essential elements from the historical and legal point of the rise and application of copyright law; it can be considered a way to stimulate the creation and protection of their inherent rights. However, sometimes the restrictions limit the access and use of scientific works.Conclusions: professionals must have a basic mastery of this content, because these creations are closely linked to the copyright law and the open educational resources in the contemporary context.Introducción: el Derecho de Autor y los derechos conexos o afines son componentes de la Propiedad intelectual. Estos protegen las creaciones expresadas en obras literarias, musicales, científicas y artísticas. En el siglo XX es universalmente reconocido como derecho humano; con el auge de las tecnologías de la informática y las telecomunicaciones y el surgimiento de Internet, adquiere nuevas dimensiones en virtud de los medios en los que se utilizan las obras. Objetivo: reflexionar en torno al Derecho de Autor y la utilización de los recursos educativos abiertos para su contribución al conocimiento por los profesionales y autores de producciones intelectuales. Desarrollo: el desconocimiento acerca del Derecho de Autor por profesionales de diferentes ramas del saber puede traer como consecuencia el plagio; para evitarlo existen instituciones mediadoras que garantizan la originalidad de las obras creadas. El trabajo aglutina los contenidos esenciales desde el punto de vista histórico y jurídico del surgimiento y aplicación del Derecho de Autor, puede considerarse una vía de estímulo a la creación y la protección sus derechos inherentes. Sin embargo, en ocasiones las restricciones que impone, limitan el acceso y uso de las obras científicas.Conclusiones: los profesionales deben tener un dominio elemental de estos contenidos, por cuanto sus creaciones se encuentran en la contemporaneidad muy vinculada a al Derecho de Autor y los recursos educativos abiertos
