Hukum Pidana Islam dan Hak Asasi Manusia; Studi atas Kasus Rajam di Ambon, Putusan Mahkamah Konstitusi No.19/PUU-VI/2008 dan Qanun Jinayah di Aceh

Not all Muslim contries gave same answer in replacing sharia in their constitution. Not all Muslim countries also able to fully accept the points stipulated in International human rights without exception or reservation. Among Muslims countries who has ratified human rights covenant , they are still in dispute on its implementation.This paper will try to see the position of sharia law in Muslim countries, the problematic of sharia formalization in Indonesia, efforts to implement Islamic criminal law in the era of reformation such as appeared in three cases : 1) the execution of rajam penalty in Ambon, 2) efforts to broaden the competency of Islamic court such as mentioned in a verdict released by Constitutional Court No19/PUU-VI/ 2008 3) efforts to promulgate qanun jinayat in Aceh province , and than continued by analysis from the politics of Islamic law (Fiqh Siyasah)
