In the work the author analyses the regulation on Telecommunications systems from two points of view: the positive law (European and national sources), and the practice of the European Commission and the National Regulatory Authorities. It emerges that the promise of creating “fewer and different norms” has up to now remained a myth, and deregulation has gone no further than the announcement. Finally, the author, looking at the 2008 ongoing revision of the Telecommunications Directives, clarifies the new role of the asymmetrical regulation: to combine competition policy with the promotion of investments in new networks.
