El abuso de la prisión preventiva en la formulación de cargos en delitos de robo en el segundo semestre del año 2021 en el cantón Cuenca

Pre-trial detention is the power of the State Attorney General's Office to require the Judges or criminal guarantees to adopt preventive measures against the accused to ensure that the accused appears in criminal proceedings, and compliance with comprehensive reparation for the benefit of the victim and the execution of the sentence. Consequently, this request can be made in two moments, a first moment in the Hearing of Flagrancy and a second moment in the Hearing to formulate charges, however, this request must be motived according to the need pf each process. The study was conducted with a qualitative-quantitative approach, using synthetic, inductive analytical methods, such as the filing technique and documentary review. The study is conducted by collecting information and tabulating where a review of the judicial file is conducted, and six questions are submitted with yes or no answers to make a summation and determine if there is an abuse in the application. In conclusion, the request will be granted or denied by the Judge of Criminal Guarantees assigned to the case. This acknowledgment must be justified, because if there is no motivation for the preventive measure, a violation of due criminal process and innocence by the Judge could be established.La prisión preventiva es la facultad de la Fiscalía General del Estado para exigir a los Jueces de garantías penales que adopten medidas preventivas contra de el imputado con el fin de asegurar que el imputado comparezca al proceso penal, y el cumplimiento de la reparación integral en beneficio de la víctima y la ejecución de la pena. En consecuencia, esta solicitud se la puede realizar en dos momentos, un primer momento en la Audiencia de Flagrancia y un segundo momento en la Audiencia de formulación de cargos, sin embargo, esta solicitud debe ser motivada conforme la necesidad de cada proceso. El estudio se realizó con un enfoque cualitativo-cuantitativo, utilizando métodos analíticos sintéticos, inductivo, como técnica de fichaje y revisión documental. El estudio se realiza mediante recolección de información y tabulación donde se realiza una revisión a los expedientes judiciales y se somete a seis preguntas con respuestas de si o no para realizar una sumatoria y determinar si existe un abuso en la aplicación. En conclusión, la solicitud será concedida o denegada por el Juez de Garantías Penales asignado a la causa.  Este reconocimiento debe tener justificación, pues si no existe una motivación de la medida preventiva, se podría establecer una violación al debido proceso penal y al de inocencia por parte del Juez
