Ética, confidencialidad y enfermería. Mi historia, ¿la historia de todos?

The nurse/patient/user relationship is presided over by the right to privacy and maintains confidentiality as the basis for development of health care. The patient/user contains information that his most intimate part to a professional in which entrusted since time immemorial, and must answer this with loyalty to this act of confidence. The codes of conduct of the health professions have always protected this relationship, joining in all of them the duty of secrecy, not laws, which have begun to pick up these aspects as rights of people from relatively recently, Constitution 1978 Spanish, Ley General de Sanidad1986. But, the legal existence of the right and duty, must not make us forget that on the day of the health care can occur situations where privacy and confidentiality are at risk, the professionals should sensitize us on these issues and besides updating our knowledge and skills we must also improve our actions so that trust that the patient/user place in us is well guarded.La relación enfermera/paciente/usuario está presidida por el derecho a la intimidad y el deber de guardar la confidencialidad como base para el desarrollo de la asistencia sanitaria. El paciente/usuario entrega información de su parte más íntima a un profesional, en el cual confía, debiendo responder éste con lealtad hacia ese acto de confianza. Los códigos deontológicos de las profesiones sanitarias han protegido siempre esta relación, incorporándose en todos ellos el deber de secreto, no así las leyes, que han comenzado a recoger estos aspectos como derechos de las personas desde hace relativamente poco tiempo, Constitución Española 1978, Ley General de Sanidad 1986. Pero, la existencia legal del derecho y del deber, no debe hacernos olvidar que en el día a día de la asistencia sanitaria pueden producirse situaciones en las que la intimidad y la confidencialidad están en peligro, los profesionales debemos sensibilizarnos en estas cuestiones y además de actualizar nuestros conocimientos y habilidades debemos también mejorar nuestras actuaciones de modo que esa confianza que los pacientes/usuarios depositan en nosotros quede bien protegida
