Analysis of the Organic Law of Comprehensive Protection of Children and Adolescents against Violence in Spain: The rights of minors involved in legal proceedings in family proceedings

This paper analyzes the changes that the recent Organic Law for the integral protection of children and adolescents against violence (LO 8/2021 of June 4) implies, in a concrete way, for the rights of children who intervene in the judicial procedure. It should never be lost sight of the fact that what should prevail over any other interest is the Best Interest of the Child, which implies an enormous responsibility of the parents and acting legal operators. On the other hand, with regard to the children's right to be heard, although it must be respected to guarantee fulfillment of law, the repercussions cannot be ignored, even branded as child abuse, that excessive pressure or interference from the parents on them can affect their psychological health, and even physical.En el presente trabajo se analizan los cambios que la reciente Ley Orgánica de protección integral a la infancia y la adolescencia frente a la violencia (LO 8/2021 de 4 de junio) supone, de manera concreta, para los derechos de los menores intervinientes en el procedimiento judicial. No debe perderse nunca de vista que lo que debe primar por encima de cualquier otro interés, es el Interés Superior del Menor (en adelante, ISM), lo que implica una enorme responsabilidad de los progenitores, y también de los operadores jurídicos actuantes. Por otro lado, en lo relativo al derecho del menor a ser escuchado, si bien debe ser respetado para garantizar el cumplimiento de la ley, no pueden obviarse las repercusiones, tildadas incluso como maltrato al menor, que una excesiva presión o interferencia de los progenitores sobre los mismos pueden acarrear en su salud psicológica, e incluso física
